4. Data Sharing and Disclosure

5. Data Retention

• We retain your data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy. If the bot is removed from a server, we will delete any data associated with that server.

• If the bot is kicked from a server, all data associated with that server will be permanently deleted to maintain a clean database and reduce unnecessary storage usage.

6. Your Rights

• You have the right to request a copy of the data we hold about you.

Correction:
• You may request correction of any inaccurate data.

Deletion:
• You can request deletion of your data where it is no longer necessary for the purposes for which it was collected.

7. Security of Your Data

• We take reasonable measures to protect your data from unauthorized access, disclosure, alteration, or destruction. However, no internet-based service can be 100% secure, so we cannot guarantee absolute security.

Terms of Service for Subscription Cancellation and Plans

1. Subscription Plans

Plan Details:
• We offer various subscription plans that provide access to premium features and commands within the Discord bot. The specific details of each plan, including pricing and features, are outlined at the time of purchase.

Billing Cycle:
• Subscriptions are billed on a monthly/annual basis, depending on the plan selected. Your billing cycle starts on the date of your subscription and recurs on the same date each billing period.

2. Cancellation Policy

Cancellation Process:
• You can cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, you will retain access to premium features until the end of your current billing cycle.

Refunds:
• If you cancel within 7 days of the initial purchase, you may be eligible for a full refund.
• After 7 days, no refunds will be issued, and you will continue to have access to the premium features until the end of the current billing period.
• No refunds are provided for renewal payments or unused time once a billing period has started.

3. Access to Premium Features After Cancellation

Continued Access:
• After you cancel your plan, you will retain access to all premium features and commands until the end of your billing period. For example, if you subscribed on 09/27/24 and cancel on 09/29/24, you will continue to have access until 10/27/24.

Data Retention:
• Data related to premium commands will remain intact until the end of your billing period. After the subscription period ends, access to premium commands and features will be revoked, but the data itself may be retained for a limited period as per our retention policy.

4. Subscription Cancellation and Feature Suspension

Immediate Suspension: Once your subscription plan is cancelled or expires, all premium commands and features will immediately cease to function. There is no grace period—access to premium services will be revoked until you renew your plan.

Reactivation Requirement: To regain access to premium commands and features, you must renew your subscription plan. Once your payment is confirmed, all functionalities will be restored promptly.

Retention Policy: Although any data or settings associated with premium features may be retained for a limited period after cancellation, the premium functionalities themselves will remain suspended until renewal. No refunds or credits will be provided for the period of lost access.

5. Plan Changes

Upgrading/Downgrading Plans:
• You may upgrade or downgrade your subscription plan at any time. Changes in plan will take effect at the beginning of your next billing cycle, and any changes to pricing will be reflected on your next invoice.

Prorated Charges:
• If you choose to upgrade your plan before the end of your current billing cycle, you will be charged a prorated amount for the remainder of the billing period. Downgrading a plan will take effect in the next billing cycle, and no refunds or credits will be issued for the current cycle.

6. Termination by Us

Non-Compliance:
• We reserve the right to terminate or suspend your access to premium features if you violate our Terms of Service or any applicable laws.

No Refunds for Violations:
• If we terminate your access due to a breach of our Terms, no refunds will be issued.

7. Changes to Subscription Plans and Pricing

Modifications:
• We reserve the right to modify or discontinue any subscription plans at any time. Pricing changes will only apply to future billing cycles, and you will be notified in advance of any changes.

Grandfathering:
• In some cases, existing subscribers may be allowed to retain their current plan and pricing for a limited period before being migrated to new plan structures.

8. Additional Support

We provide support for all subscribers during the active subscription period. Support includes bug fixes and guidance on using premium features. Additional support beyond this period may incur extra fees.

9. Transfer Policy

Initial Server Selection:
• Upon purchasing a premium subscription, users must choose a specific Discord server to activate the premium commands and features.

Free Transfer:
• Users are allowed one free transfer of their premium commands to another Discord server.

Transfer Waiting Period:
• After the first transfer, subsequent transfers can only be requested after a waiting period of 7 days. This cooldown ensures smooth transitions between servers.

Data Deletion Upon Transfer:
• Once the premium commands are transferred to a new server, all premium-related data from the previous server will be permanently deleted. This includes any configurations, command histories, or saved premium features associated with the original server.

Limitations:
• Users can only transfer premium commands to one server at a time.
• After the free transfer, any additional transfer requests will require users to wait 7 days before initiating the next transfer.

No Data Recovery:
• Once premium data is deleted from the previous server, it cannot be recovered, so users should ensure they are ready to move before requesting a transfer.

Terms of Service for Custom Discord Bots

These Terms of Service ("Terms") govern your use of the custom Discord bot development services provided by Cogit Development ("we," "our," or "us"). By purchasing or using our custom bot development services, you agree to these Terms. Please read them carefully before proceeding.

1. Services Provided

Scope of Work:
• You are responsible for providing clear and accurate specifications for your custom bot. Changes to the scope of work after development has started may result in additional charges.

Compliance:
• You agree to use the custom bot in compliance with Discord’s Terms of Service, Community Guidelines, and applicable laws. We are not responsible for how the bot is used after delivery.

2. Payment and Fees

Pricing:
• The pricing for the custom bot will be determined based on the complexity and requested features. Payment terms will be communicated to you before development begins.

Payment Terms:
• A non-refundable deposit of 5% is required before development begins. The remaining balance must be paid upon completion and delivery of the bot.

Refund Policy:
• Refunds are not provided once the development work has started. However, if we are unable to fulfill the agreed-upon project requirements, partial refunds may be considered on a case-by-case basis.

3. Ownership

Source Code:
• Upon full payment, you will receive ownership of the custom bot and its source code. We reserve the right to retain a copy of the bot for portfolio and support purposes.

Licensing:
• You will be granted a non-exclusive license to use the custom bot for your Discord server(s). Redistribution or reselling of the bot or its code is strictly prohibited unless explicitly agreed upon.

4. Support and Maintenance

Initial Support:
• We provide support for bug fixes and minor adjustments within 7 days after the delivery of the bot, free of charge.

Ongoing Support:
• After the initial support period, ongoing maintenance or feature updates may be subject to additional fees.

5. Termination

Cancellation by Client:
• You may cancel the project at any time. However, any work completed up to the date of cancellation will be billed, and any deposits made will not be refunded.

Termination by Us:
• We reserve the right to terminate the project if you breach these Terms or fail to provide necessary materials and information.

6. Liability

No Liability for Misuse:
• We are not liable for any damages or losses resulting from the misuse of the custom bot, including actions that violate Discord's Terms of Service or local laws.

Limitations of Liability:
• To the maximum extent permitted by law, our liability for any claim arising out of this agreement will be limited to the amount paid for the custom bot development service.

7. Confidentiality

• We agree to keep all project-related details, source code, and server information confidential. Similarly, you agree not to disclose proprietary methods or tools used in the bot's development.

8. Intellectual Property

• Any custom features or unique systems developed specifically for your bot are considered intellectual property owned by Cogit Development. You are granted a license to use these features in your bot, but not to replicate or resell them without permission.

9. Modifications to the Terms

• We reserve the right to update or modify these Terms at any time. Any changes will be communicated to you, and continued use of our services after modifications will signify your acceptance of the updated Terms.

10. Dispute Resolution

• Any disputes arising from these Terms or our services will be resolved through [Arbitration/Mediation], unless otherwise required by applicable law.

11. Security and Encryption

• All custom scripts developed by Cogit Development are encrypted to ensure the security and integrity of the code.
• We guarantee that our scripts are free from malware or any malicious components. Your safety and trust are our top priorities.

These Terms of Service ("Terms") govern your use of the custom FiveM script development services provided by Cogit Development ("we," "our," or "us"). By purchasing or using our custom script development services, you agree to these Terms. Please read them carefully before proceeding.

1. Payment and Fees

Payment Options:
• Customers can choose to either pay the full amount upfront or pay 50% of the total amount to begin the development process.

Development Process:
• The server will be developed on a personal VPS owned by us until completion.
• Once the development is complete, the customer will be given access to review the server before making the final payment.

Final Payment and Delivery:
• After approval, the remaining 50% of the payment must be made before the server is transferred to the customer’s VPS or hosting service.

Clients with an Existing VPS or Hosting provider:
• If the client already has a VPS or Hosting provider and wants to update or create a new FiveM server from scratch, full payment must be made before any progress begins.

2. Refund Policy

Cancellation Policy:
• If a customer is unsure about proceeding, it is recommended to pay only 50% upfront.
• If the customer cancels the order after development has begun, the initial 50% payment is non-refundable.

Full Payment Refund Policy:
• If a customer pays the full amount upfront and later decides to cancel for reasons unrelated to the product’s quality, no refund will be issued.
• If the customer is dissatisfied with the server's development due to reasonable concerns, a full refund may be considered.

3. Ownership

Server Files:
• Upon full payment, the customer will receive ownership of the FiveM server files and configurations.
• We reserve the right to retain a backup copy for support and portfolio purposes.

4. Support and Maintenance

Initial Support:
• We provide support for bug fixes and minor adjustments within 7 days after delivery, free of charge.

Ongoing Support:
• After the initial support period, further maintenance or feature updates may be subject to additional fees.

5. Termination

Cancellation by Client:
• The customer may cancel the project at any time. However, any work completed up to the date of cancellation will be billed, and any deposits made will not be refunded.

Termination by Us:
• We reserve the right to terminate the project if the customer breaches these Terms or fails to provide necessary information to complete the project.

Terms of Service Of Websites

Cogit Development ("we," "us," or "our") offers professional website development services. This section outlines our policies regarding payment, project completion, and hosting options. By using our services, you agree to these terms. If you do not agree, please refrain from requesting our website development services.

Payment Terms

• Clients have the option to either pay the full amount upfront or upon project completion. All payments must be made in full before the website is delivered.

Project Completion and Delivery

• All websites are developed on a personal VPS provided by us. Once the project is completed and full payment has been received, the website will be handed over to the client. At this point, clients can choose to either host the website themselves or allow us to host it for them.

Hosting Services

• If the client chooses to host their website with us, they will be required to pay a hosting fee of $20 per month. This fee ensures server maintenance, uptime monitoring, and security updates.

Non-Payment Policy

• If payment is not received upon project completion, the project will be terminated, and the client will not receive access to the website files or any associated services.
